The UAE has recently introduced new legal provisions allowing abortions in cases of rape, incest, and other specific situations. The aim is to reduce unsafe practices for unwanted pregnancies. According to a new cabinet resolution, abortions can now be performed by licensed physicians if the pregnancy results from rape or incest, or at the request of spouses with committee approval. These are in addition to the existing conditions where a woman’s life is at risk or if the fetus is deformed. Detailed Conditions

The resolution specifies that a specialist obstetrician-gynaecologist, licensed to practice in the UAE, can perform the procedure at a licensed healthcare facility. Before and after the procedure, the woman must receive medical and social counselling. Additionally, abortions are permitted only if they do not pose a medical risk to the woman’s life and must be performed within the first 120 days of pregnancy. The law applies to both Emiratis and expats, with non-Emiratis needing to reside in the UAE legally for at least a year before requesting an abortion.

Committee & Approval Process

The Ministry of Health and Prevention (MoHAP) will establish committees within each health authority to oversee the approval process. These committees will include obstetrics/gynaecology specialists, psychiatry experts, and a representative from the Public Prosecution. Rape and incest cases must be supported by an official report from the public prosecution.

Legal experts believe this change is a significant step towards preserving women’s health and reducing illegal abortion practices. Dr. Habib Al Mulla emphasised the need for official reports in cases of rape and incest, while Samara Iqbal highlighted the alignment with international standards and the enhancement of women’s autonomy and health.

These changes are part of the UAE’s broader efforts to modernise its legal system, promoting gender equality and improving women’s rights. Recent reforms have also addressed domestic violence, discrimination, and women’s rights in family courts, allowing for no-fault divorce and better spousal maintenance claims.
